Twitter in court over alleged breaches of Online Safety Act

X, formerly Twitter, is being taken to the Federal Court for allegedly failing to comply with a transparency notice related to sexual exploitation under the Online Safety Act.

The notice required information about how the provider was meeting the Basic Online Safety Expectations in relation to child sexual exploitation and abuse material and activity.

Independent regulator for online safety eSafety alleges X failed to respond or failed to respond truthfully and accurately to certain questions.

X, issued a $610,500 infringement notice in September, for its failure to comply with the notice, asked for a judicial review.

eSafety is requesting the judicial review be heard in tandem with civil penalty proceedings in the Federal Court.

The regulator says some of the biggest tech companies aren’t living up to their responsibilities to tackle the proliferation of child sexual exploitation, sexual extortion and the livestreaming of child sexual abuse. 

In February, eSafety also issued legal notices to Google, TikTok, Twitch and Discord.
