ACMA seeking public feedback on TV prominence framework

ACMA has released a public consultation paper seeking views on implementing Australia’s new TV prominence framework.

From January 2026, all connected TV devices sold in Australia must comply with new rules made under the Broadcasting Services Act 1992. These rules are designed to make it easier for Australians to find and access free-to-air services and apps on their smart TVs and similar devices.

In July, the parliament passed the government's Communications Legislation Amendment (Prominence and Anti-siphoning) Bill 2024, which introduced a 'must-carry' prominence framework to ensure that local free-to-air television services can easily be found on connected television devices in Australia.

The ACMA will oversee and enforce the TV prominence framework, as well as being granted new powers.

This may involve determining which devices must comply with the minimum prominence requirements; where on the user interface (the home screen, landing page or similar) the rules must be met; and how TV services will be deemed to have been ‘offered’ for installation on devices.

Feedback and evidence from the consultation will help determine if, and how, the industry body uses its powers.

ACMA is seeking the public's views on the types of devices that should be included, how regulated TV services and apps should be displayed and how broadcasters will make their apps available to device manufacturers.

Submissions will be accepted until October 15 2024.
