
As the advertising sector navigates iOS headwinds, a battle is brewing over App Store terms.
A lawsuit by Epic Games against Apple in Australia will go to trial in 2024, following a Federal Court ruling.
The trial, originally slated for November 2022, has been shifted due to procedural concerns over a similar dispute between Epic Games and Google.
Epic Games has lawsuits against both platforms in several global markets, alleging Apple’s App Store and Google’s Play Store are anti-competitive towards developers.
Epic Games’ Fortnite was removed from the app sites after bypassing their payment schemes.
The Australian lawsuit against Apple was initially set for later this year, with Google expected to follow in 2024.
Justice Nye Perram has now scheduled 18 weeks commencing in March 2024 to hear both cases.
“It is not realistic to expect that the opinions of one set of economic experts on the market issues in the first case can be put out of mind when embarking upon the hearing of the same issue on different evidence in the second case. Consequently, this may well give rise to an apprehension of bias," he ruled.
